資料刪除指示

根據香港《個人資料(私隱)條例》第26條,資料使用者須在個人資料不再需要時將其刪除。本頁面說明你如何要求派學刪除你的個人資料,以及我們的處理程序。

Under section 26 of the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong, a data user must delete personal data when it is no longer required. This page explains how you can request PadLearn to delete your personal data and our handling procedures.

1. 何時可以要求刪除資料? / When Can You Request Deletion?

你可以在以下情況提出刪除請求:
You may request deletion in the following situations:

  • 帳戶關閉 / Account closure:你決定關閉派學帳戶。
    You decide to close your PadLearn account.
  • 不再需要 / No longer needed:你認為你的個人資料不再需要用於提供服務(例如畢業後不再需要學習支援)。
    You believe your personal data is no longer needed for the provision of services (e.g., after graduation, no longer need learning support).
  • 撤回同意 / Withdrawal of consent:你撤回對我們使用你資料的同意(如情感分析功能),且沒有其他法律依據保留該資料。
    You withdraw your consent to our use of your data (e.g., for sentiment analysis), and there is no other legal basis for retaining the data.
  • 學校要求 / School request:學校要求刪除畢業生或離校學生的帳戶及相關資料。
    The school requests deletion of the accounts and related data of graduating or departing students.

請注意,如果資料仍然需要用作履行服務(例如你仍有進行中的作業批改),我們可能無法即時刪除,但會在服務完成後處理。

Please note that if the data is still needed for performing the service (e.g., you have ongoing assignment marking), we may not be able to delete it immediately, but will do so after the service is completed.

2. 不同用戶的刪除請求方式 / Deletion Request Methods by User Role

用戶角色 / User Role 刪除程序 / Deletion Procedure
學生 / Student 由於學生多未滿 18 歲,請家長或學校代表代為提出請求。

家長:登入家長應用程式後,於「設定」中選擇「要求刪除子女帳戶」。
學校:管理員可透過管理後台批量刪除。
As students are mostly under 18, please ask a parent or school representative to make the request on your behalf.

Parents: After logging into the parent app, select "Request to delete child's account" in "Settings".
Schools: Administrators can batch delete via the admin panel.
教師 / Teacher 1. 登入平台後,於「帳戶設定」→「刪除帳戶」,按指示確認(需輸入密碼)。
2. 或發送電郵至 data@padlearn.hk,主旨「個人資料刪除請求-教師」,並提供姓名及註冊電郵。

1. After logging into the platform, go to "Account Settings" → "Delete Account", confirm as instructed (password required).
2. Or send an email to data@padlearn.hk with subject "Personal Data Deletion Request – Teacher", providing your name and registered email.
家長 / Parent 登入家長應用程式後,於「設定」→「刪除我的帳戶」。

注意:刪除家長帳戶不會自動刪除子女帳戶。子女帳戶須由學校或家長另行處理。
After logging into the parent app, go to "Settings" → "Delete My Account".

Note: Deleting a parent account does not automatically delete the child's account. The child's account must be handled separately by the school or parent.
學校管理員 / School Administrator 透過管理後台,選取畢業生或離校學生的帳戶,點擊「批量刪除」。個別請求請電郵 data@padlearn.hk。
Via the admin panel, select the accounts of graduating or departing students and click "Batch Delete". For individual requests, please email data@padlearn.hk.

3. 提出刪除請求需要提供的資料 / Information Required for a Deletion Request

為核實身份,請提供以下資料(越詳細越快處理):
To verify your identity, please provide the following information (the more detailed, the faster the processing):

  • 用戶名稱(顯示名稱)/ Username (display name)
  • 註冊電郵地址(必填)/ Registered email address (required)
  • 學校名稱(如適用)/ School name (if applicable)
  • 用戶角色(學生/教師/家長/學校管理員)/ User role (student / teacher / parent / school administrator)
  • 欲刪除的帳戶 ID(如知悉)/ Account ID to be deleted (if known)
  • 請求刪除的原因(可選,但協助我們理解是否有替代方案)/ Reason for deletion request (optional, but helps us understand if there are alternatives)

4. 處理時間與流程 / Processing Time and Procedure

  • 接收確認 / Acknowledgment of receipt:我們會在收到請求後的 2 個工作日內發送確認電郵。
    We will send a confirmation email within 2 working days after receiving the request.
  • 處理期限 / Processing deadline:我們會於 30 天內完成刪除。如個案複雜(例如需要從多個系統中移除),可能延長至 90 天,屆時會通知你。
    We will complete the deletion within 30 days. For complex cases (e.g., requiring removal from multiple systems), we may extend to 90 days and will notify you.
  • 處理狀態查詢 / Status enquiry:你可隨時電郵 data@padlearn.hk 查詢進度,請提供原請求的電郵日期。
    You may email data@padlearn.hk at any time to check the status, providing the date of your original request email.

5. 可能無法立即刪除或拒絕刪除的情況 / Circumstances Where Deletion May Be Delayed or Refused

在以下情況,我們可能無法立即刪除,或會拒絕刪除請求:
In the following circumstances, we may be unable to delete immediately or may refuse the deletion request:

  • 服務進行中 / Ongoing services:有關資料仍在處理中的服務請求(如未完成的作業批改、進行中的模擬考試)。我們會在完成後再處理。
    The data is still being used for an ongoing service request (e.g., incomplete assignment marking, an ongoing mock exam). We will process the deletion after completion.
  • 法律義務 / Legal obligations:法律要求我們保留該資料(如稅務或財務紀錄,通常保留 7 年;或須配合執法調查)。
    The law requires us to retain the data (e.g., tax or financial records, typically retained for 7 years; or to cooperate with law enforcement investigations).
  • 法律糾紛 / Legal disputes:發生法律糾紛,需要保留相關資料作為證據。
    A legal dispute has arisen and the data is needed as evidence.
  • 匿名化資料 / Anonymised data:資料已匿名化且無法識別個人身份。匿名化數據可用於改進 AI 模型,此類數據不受刪除請求影響。
    The data has been anonymised and can no longer identify an individual. Anonymised data may be used to improve AI models and is not subject to deletion requests.
  • 重複請求 / Repeated requests:你在短時間內多次提出刪除又取消,我們可能會暫停處理。
    You repeatedly request deletion and then cancel it within a short period; we may suspend processing.

如拒絕請求,我們會書面解釋原因。
If we refuse a request, we will explain the reasons in writing.

6. 刪除後的影響 / Consequences of Deletion

請務必了解刪除後的後果:
Please be aware of the following consequences after deletion:

  • 帳戶永久關閉 / Permanent account closure:你將無法登入,也無法恢復帳戶或任何資料。
    You will no longer be able to log in, and your account or any data cannot be recovered.
  • 學習記錄遺失 / Loss of learning records:你過往的學習記錄、作業、報告、AI 對話記錄將不可存取。
    Your past learning records, assignments, reports, and AI conversation logs will become inaccessible.
  • 學校無法追蹤 / School cannot track:如你是學校管理的學生,刪除後學校將無法查閱你的學習進度,可能影響學生成績評估。
    If you are a student managed by a school, the school will no longer be able to access your learning progress, which may affect student assessment.
  • 家長無法查閱 / Parent cannot access:如你是家長,刪除後將無法查閱子女的學習資訊及接收預警。
    If you are a parent, you will no longer be able to view your child's learning information or receive alerts.
  • 匿名數據保留 / Anonymised data retained:你的匿名化學習數據可能仍保留用於模型訓練,但無法再與你本人關聯。
    Your anonymised learning data may still be retained for model training but can no longer be associated with you.
  • 備份資料 / Backup data:刪除請求完成後,資料將從我們的主動系統中移除,但可能仍存於備份系統中一段時間(最長 90 天),直至備份循環覆蓋。備份中的資料不會被用於任何用途。
    After the deletion request is completed, data will be removed from our active systems but may remain in backup systems for a period (up to 90 days) until backups are overwritten. Data in backups will not be used for any purpose.

7. 如何撤回刪除請求 / How to Withdraw a Deletion Request

若你改變主意,可在我們處理完成前發送電郵至 data@padlearn.hk 撤回請求。請在主旨註明「撤回刪除請求-[你的電郵]」。撤回後,你的帳戶將恢復正常(如尚未刪除)。如已部分刪除(例如已移除作業記錄),可能無法恢復。
If you change your mind, you may withdraw your request by emailing data@padlearn.hk before we complete the processing. Please include in the subject line "Withdrawal of Deletion Request – [your email]". After withdrawal, your account will return to normal (if not yet deleted). If partial deletion has already occurred (e.g., assignment records have been removed), those may not be recoverable.

8. 學校批量刪除的操作指引 / Guidelines for School Batch Deletion

學校管理員可在後台執行以下操作:
School administrators can perform the following operations in the admin panel:

  • 畢業生處理 / Graduating students:學年結束後,可批量選擇畢業年級的學生,點擊「刪除帳戶」。系統會提示確認刪除並說明後果。
    After the end of the school year, you may batch‑select students in the graduating class and click "Delete Account". The system will prompt for confirmation and explain the consequences.
  • 離校生處理 / Departing students:可搜尋特定學生,單獨刪除。
    You may search for a specific student and delete individually.
  • 資料匯出 / Data export:刪除前,學校可選擇匯出學生的學習報告作備存(需遵守私隱政策)。
    Before deletion, schools may choose to export students' learning reports for archiving (subject to the Privacy Policy).
  • 審計日誌 / Audit logs:後台會記錄所有刪除操作,包括操作人、時間、刪除的帳戶數量。
    The admin panel logs all deletion operations, including the operator, time, and number of accounts deleted.

9. 第三方服務的資料刪除 / Data Deletion from Third‑Party Services

派學使用第三方服務(如阿里雲、SleekFlow)。我們會確保這些服務商在合約終止時刪除或歸還所有個人資料。但你有權要求我們通知這些服務商執行刪除。如你經由第三方服務(如 Google 登入)創建帳戶,請另行參閱該第三方的資料刪除政策。
PadLearn uses third‑party services (e.g., Alibaba Cloud, SleekFlow). We will ensure that these service providers delete or return all personal data upon contract termination. However, you have the right to request that we instruct these service providers to carry out deletion. If you created your account via a third‑party service (e.g., Google login), please also refer to that third party's data deletion policy.

10. 免責聲明 / Disclaimer

我們會盡最大努力安全、完整地刪除你的資料,但鑑於技術限制(例如備份系統、匿名化數據),無法保證所有複本均被徹底清除。然而,已刪除的個人資料不會再被用於任何用途,且無法恢復。
We will make our best efforts to safely and completely delete your data. However, due to technical limitations (e.g., backup systems, anonymised data), we cannot guarantee that all copies will be completely erased. Nevertheless, deleted personal data will not be used for any purpose and cannot be recovered.
