1. 服務描述 / Description of Service

派學是一個專為香港中學文憑試（DSE）師生及家長設計的 AI 學習平台，提供但不限於以下功能：
PadLearn is an AI learning platform designed for Hong Kong DSE students, teachers, and parents, providing (but not limited to) the following features:

• AI 智能批改（手寫識別、DSE 評分標準）
  AI intelligent grading (handwriting recognition, DSE marking standards)
• 個性化學習路徑推薦
  Personalised learning path recommendations
• AI 模擬試卷生成
  AI mock exam paper generation
• 知識點雷達圖與學習報告
  Knowledge radar charts and learning reports
• 校園安全預警（情感分析、欺凌風險評分、匿名求助）
  Campus safety alerts (sentiment analysis, bullying risk scoring, anonymous help)
• 家校溝通工具（訊息、報告分享）
  Home‑school communication tools (messaging, report sharing)

我們保留隨時增加、修改或停止部分功能的權利，並會提前通知。
We reserve the right to add, modify, or discontinue any feature at any time with prior notice.

2. 帳戶註冊及使用資格 / Account Registration and Eligibility

• 學校帳戶 / School accounts：由學校管理員代表學校註冊，須提供有效的學校電郵地址。
  Registered by a school administrator on behalf of the school, using a valid school email address.
• 教師帳戶 / Teacher accounts：由學校管理員建立，或教師使用學校電郵自行註冊，須經學校確認。
  Created by a school administrator, or self‑registered by a teacher using a school email address, subject to school confirmation.
• 學生帳戶 / Student accounts：由學校或家長協助註冊。如你未滿 18 歲，你確認已獲得父母或監護人同意。
  Registered with the assistance of a school or parent. If you are under 18, you confirm that you have obtained parental or guardian consent.
• 家長帳戶 / Parent accounts：由家長自行註冊，並關聯其子女的學生帳戶。註冊時須驗證家長身份（如透過學校提供的子女學號）。
  Self‑registered by a parent and linked to their child's student account. Parent identity verification (e.g., via the child's student number provided by the school) is required.

你必須提供真實、準確且完整的資料，並在有變更時及時更新。我們可能會透過電郵驗證你的帳戶。
You must provide true, accurate, and complete information and keep it updated. We may verify your account via email.

3. 用戶行為規範 / User Conduct

你同意不會：
You agree not to:

• 上載、發布任何違反香港法律的內容，包括但不限於：淫穢、色情、暴力、歧視、誹謗、騷擾、威脅、仇恨言論；侵犯他人知識產權（如未經授權使用版權教材）；假冒他人或未經授權使用他人帳戶。
  Upload or post any content that violates Hong Kong law, including but not limited to: obscene, pornographic, violent, discriminatory, defamatory, harassing, threatening, or hateful speech; infringing intellectual property rights (e.g., unauthorised use of copyrighted textbooks); impersonating another person or using another's account without authorization.
• 干擾派學平台的正常運作，包括：使用自動化工具（機器人）大量存取；嘗試入侵伺服器、破解安全措施；發動拒絕服務攻擊。
  Interfere with the normal operation of the PadLearn platform, including: using automated tools (bots) to make excessive requests; attempting to hack servers or bypass security measures; launching denial‑of‑service attacks.
• 利用派學進行任何非法活動，如詐騙、勒索、騷擾。
  Use PadLearn for any illegal activity, such as fraud, extortion, or harassment.
• 未經他人同意收集或分享其個人資料。
  Collect or share another person's personal data without their consent.
• 故意輸入虛假資料以影響 AI 模型的準確性。
  Deliberately input false data to affect the accuracy of AI models.

4. 用戶內容許可 / License to User Content

你保留你上載至平台的內容（如作業答案、提問、作文）的知識產權。
You retain all intellectual property rights in the content you upload to the platform (e.g., assignment answers, questions, essays).

你授予派學一個非專屬、全球性、免版稅的許可，以使用、託管、儲存、複製、展示及分發該內容，僅用於提供及改進服務（例如：使用你的作文來訓練 AI 批改模型，但會進行匿名化處理）。此許可在你的帳戶終止後仍持續有效，惟我們會停止使用可識別身份的個人內容。
You grant PadLearn a non‑exclusive, worldwide, royalty‑free license to use, host, store, copy, display, and distribute your content solely for the purpose of providing and improving the service (e.g., using your essay to train the AI grading model after anonymisation). This license survives termination of your account, but we will cease using content that identifies you personally.

若你上載的內容包含他人的個人資料（如學生的姓名），你保證已取得該人士的同意。
If your content contains another person's personal data (e.g., a student's name), you warrant that you have obtained that person's consent.

我們不會將你的內容用於直接行銷或出售給第三方。
We will not use your content for direct marketing or sell it to third parties.

5. 知識產權 / Intellectual Property

派學平台本身（包括軟件、源代碼、設計、文字、圖像、AI 模型、商標、標誌）的所有知識產權均屬 LittleP AI Limited 或其授權人所有。未經我們書面許可，你不得：
All intellectual property rights in the PadLearn platform itself (including software, source code, design, text, images, AI models, trademarks, logos) are owned by LittleP AI Limited or its licensors. Without our written permission, you may not:

• 複製、修改、逆向工程、反編譯或破解平台的任何部分。
  Copy, modify, reverse engineer, decompile, or disassemble any part of the platform.
• 使用派學的商標或標誌作商業用途。
  Use PadLearn's trademarks or logos for commercial purposes.
• 移除平台上的任何版權或商標標示。
  Remove any copyright or trademark notices from the platform.

6. 帳戶安全與責任 / Account Security and Responsibility

你對你的帳戶登入憑證（用戶名、密碼）保密負責。如你發現任何未經授權使用你帳戶的情況，須立即通知我們。我們對因你未能保護帳戶資料而造成的損失不承擔責任，但我們會採取合理措施協助你恢復帳戶控制。
You are responsible for maintaining the confidentiality of your login credentials (username, password). If you become aware of any unauthorised use of your account, you must notify us immediately. We will not be liable for any loss caused by your failure to protect your account information, but we will take reasonable steps to help you regain control of your account.

學校管理員有責任確保所管理的教師及學生帳戶的使用符合本條款。
School administrators are responsible for ensuring that the teacher and student accounts they manage comply with these Terms.

7. 付款與退款（適用於付費計劃）/ Payment and Refunds (for Paid Plans)

現階段派學對試點學校免費。日後如有收費，相關費用將於訂購頁面列明。
At present, PadLearn is free for pilot schools. Any future fees will be specified on the ordering page.

• 付費計劃 / Paid plans：可能按學校規模、功能模組或用量收費。訂閱計劃會自動續期，除非你提前取消。
  May be charged based on school size, feature modules, or usage. Subscriptions will automatically renew unless cancelled in advance.
• 退款政策 / Refund policy：由於數碼服務的特殊性，除非適用法律另有規定（如香港《不合情理合約條例》），已支付的費用一般不予退款。我們會按比例退還尚未提供的服務部分。
  Due to the nature of digital services, fees paid are generally non‑refundable unless otherwise required by applicable law (e.g., the Unconscionable Contracts Ordinance of Hong Kong). We will refund a pro‑rata portion for services not yet rendered.
• 欠款處理 / Late payment：如逾期未付款，我們有權暫停服務直至款項付清。
  If payment is overdue, we may suspend the service until the amount is paid in full.

8. 暫停與終止服務 / Suspension and Termination

我們可能在以下情況暫停或終止你的帳戶：
We may suspend or terminate your account in the following circumstances:

• 你違反本條款（會先發出警告，嚴重違規則立即終止）。
  You violate these Terms (warning issued first; immediate termination for material breach).
• 你不再使用派學或要求刪除帳戶。
  You stop using PadLearn or request account deletion.
• 學校客戶的服務合約到期或終止。
  The school customer's service contract expires or is terminated.
• 我們合理相信有必要保護派學平台、其用戶或公眾免受潛在損害（例如安全漏洞）。
  We reasonably believe it is necessary to protect the PadLearn platform, its users, or the public from potential harm (e.g., a security vulnerability).

暫停或終止後，你將無法存取你的帳戶及內容。我們會根據「資料刪除指示」處理你的個人資料。
Upon suspension or termination, you will no longer be able to access your account or content. Your personal data will be handled in accordance with the "Data Deletion Instructions".

9. 免責聲明 / Disclaimer

服務按「現況」及「可提供」基礎提供。我們不保證服務無間斷、及時、安全或無錯誤。
The service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, timely, secure, or error‑free.

AI 服務的局限性 / Limitations of AI services：

派學使用生成式人工智能技術。AI 的輸出可能不完美，我們已採取合理措施確保準確性（例如使用 DSE 評分標準微調、知識庫檢索），但不能完全保證沒有錯誤。教師應覆核 AI 批改結果，及審查 AI 生成的模擬試卷的適合性。對於因依賴 AI 輸出而導致的任何學業損失，我們不承擔責任。
PadLearn uses generative AI technology. AI output may not be perfect; we have taken reasonable steps to ensure accuracy (e.g., fine‑tuning with DSE marking standards, knowledge base retrieval), but cannot guarantee error‑free results. Teachers should review AI grading results and the suitability of AI‑generated mock exam papers. We are not liable for any academic loss resulting from reliance on AI output.

校園安全預警 / Campus safety alerts：

情感分析旨在輔助及早識別潛在風險，不能取代專業心理健康評估或干預。如你發現學生有即時危險，應立即聯絡學校社工或相關專業人士。
Sentiment analysis is intended as an aid for early identification of potential risks and is not a substitute for professional mental health assessment or intervention. If you believe a student is in immediate danger, you should contact the school social worker or a relevant professional immediately.

不可抗力 / Force majeure：

對於因自然災害、網絡中斷、政府行動、戰爭、恐怖襲擊、供應商故障等超出我們合理控制範圍的原因導致的服務中斷或資料遺失，我們不承擔責任。
We are not liable for service interruptions or data loss caused by events beyond our reasonable control, such as natural disasters, network outages, governmental actions, war, terrorist attacks, or supplier failures.

第三方連結 / Third‑party links：

派學可能包含通往第三方網站的連結。我們對該等網站的內容或私隱實務不負責任。你應查閱該等網站的條款。
PadLearn may contain links to third‑party websites. We are not responsible for the content or privacy practices of such websites. You should review their terms.

10. 責任限制 / Limitation of Liability

在法律允許的最大範圍內：
To the maximum extent permitted by law:

• 我們對因使用或無法使用派學而引起的任何間接、附帶、特殊、懲罰性損害（包括但不限於利潤損失、商譽損失、數據丟失）不承擔責任。
  We will not be liable for any indirect, incidental, special, or consequential damages (including but not limited to loss of profits, goodwill, or data) arising from the use or inability to use PadLearn.
• 我們對任何單一用戶的總責任上限不超過你過去 12 個月向我們支付的費用（或如免費使用者，上限為港幣 500 元）。
  Our total liability to any single user shall not exceed the fees paid by you to us in the preceding 12 months (or, for free users, HKD 500).

11. 賠償 / Indemnification

你同意就因你違反本條款或使用服務而對我們造成的一切索償、損害、損失及費用（包括合理的律師費），向我們作出賠償。
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your use of the service.

12. 適用法律及司法管轄權 / Governing Law and Jurisdiction

本條款受香港特別行政區法律管轄，並依其解釋，不考慮衝突法原則。任何因本條款引起的爭議，應先透過友好協商解決；協商不成，雙方同意提交香港法院專屬管轄。
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles. Any dispute arising from these Terms shall first be settled through friendly negotiation; if negotiation fails, the parties agree to submit to the exclusive jurisdiction of the courts of Hong Kong.

13. 條款修改 / Changes to Terms

我們保留隨時修改本條款的權利。重大變更（例如新增費用、大幅縮減服務範圍）會提前至少 30 天透過平台公告或電郵通知你。你繼續使用服務即表示接受修改後的條款。如你不同意，應立即停止使用並刪除帳戶。
We reserve the right to modify these Terms at any time. Material changes (e.g., introducing fees, significantly reducing the scope of service) will be notified at least 30 days in advance via platform announcement or email. Your continued use of the service after such changes constitutes your acceptance of the modified Terms. If you do not agree, you should stop using the service and delete your account.

14. 通知 / Notices

我們可能透過電郵、平台通知或網站公告向你發送通知。電郵通知會發送至你註冊的地址，並視為發出後 24 小時送達。
We may send notices to you via email, platform notifications, or website announcements. Email notices will be sent to your registered address and shall be deemed received 24 hours after sending.
